Few recent EU initiatives have attracted as much enthusiasm from founders and political leaders as the ‘28th regime’ – a single, opt-in European rulebook intended to simplify cross-border entrepreneurship. But a narrow focus on company law leaves legal barriers to scaling untouched. The Commission should combine its company law proposal with targeted, time-limited regulatory pilots in areas such as insolvency and labour mobility to test deeper harmonisation.
